To enter, complete and submit the entry form on http://www.playboy.com/perfectstrangersweeps. All entries must be received by Friday, September 14 , 2007 at 11:59 p.m. (EST time). Only one entry per email address, per person for the entire sweepstakes will be accepted. Only those entrants with completed entry forms will be entered for a chance to win. Entries that are incomplete or illegible will be disqualified. Playboy.com, Inc. (“PCI”), Sony Pictures Home Entertainment, Inc., Hilltop New Media, Inc. and their parent companies, subsidiaries, affiliates, agents, licensees and retailers (collectively, the “Sweepstakes Entities") are not responsible for incorrect, inaccurate, lost, late, misdirected, undeliverable or damaged e-mail or malfunctions, interruptions or disconnections in phone lines or network hardware or software whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized in the sweepstakes. By entering sweepstakes, entrants, grand prize winner and travel companion agree and acknowledge to be bound by the decisions of PCI which are final and binding in all respects; to waive any rights to claim ambiguity with the Official Rules and that the Sweepstakes Entities and their respective employees, agents, officers, and directors (including advertising and promotional agencies) and distributors, licensees and retailers shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this sweepstakes; human error; incorrect or inaccurate transcription of entry information; acceptance/possession, use/misuse, and/or defects of the prizes awarded herein; and/or any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access sweepstakes or any web site or online service via the internet due to hardware or software compatibility problems; any damage to entrants (or any third person’s) computer and/or its contents related to or resulting from any part of this sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Entrants, winners and travel companion further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the sweepstakes, to release all rights to bring any claim, action or proceeding against any of the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including express warranties provided exclusively by a prize supplier that are sent along with a prize.
2. GENERAL CONDITIONS. PCI has the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of this sweepstakes or web site; to be in violation of the terms of service of the web site, to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the sweepstakes at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. By opting-in to specific offers from any of the Sweepstakes Entities, entrant’s entry information will be subject to Sweepstakes Entities’ respective privacy policies and terms of service and entrant is agreeing to receive additional email communication from those companies.
If, for any reason, the sweepstakes is not capable of running as planned by reason of any occurrence such as infection by computer virus, worms, bugs, tampering, authorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of PCI, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, PCI reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Internet portion of this sweepstakes for any drawing(s) and select the winners from qualified Internet entries received prior to or after (if applicable) the termination, modification or suspension, or in a manner that is fair and equitable.
3. ELIGIBILITY. Each contestant must be 18 years old or older at the time of entry and a legal U.S. or D.C. resident and must have Internet/email access prior to August 7, 2007. Employees any of the Sweepstakes Entities, their respective parents, affiliates, subsidiaries, directors, officers and agents (collectively “Ineligible Entities”), family members of any Ineligible Entities (parents, children, siblings, spouses) and/or those living in the same household as such Ineligible Entities (whether related or not), the Sweepstakes Entities advertising agencies, promotion agencies, retailers and judging organizations are not eligible to enter or win. Sweepstakes void WHERE restricted OR PROHIBITED by law.
4. DRAWING AND NOTIFICATION. There will be one (1) potential Grand Prize winner and five (5) potential First Prize winners (collectively, the “Winners”) who will be chosen at random from the eligible entries for the prizes on the business day following the end of the sweepstakes. Attempts will be made to notify the potential Winners by phone within not more than five (5) business days following winner selection. In the event a potential Winner either cannot be reached after a reasonable effort has been exerted, then that potential Winner will be disqualified and will have forfeited the prize and another potential Winner will be selected at that time. This process will continue until a Winner has responded and has fulfilled the other requirements set forth in these Official Rules for the prize to be fulfilled to the Winner. Grand Prize Winner (his/her parent/legal guardian if Grand Prize Winner is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, have notarized and return an Affidavit of Eligibility and Liability/Publicity Release (where not prohibited by law) within not more than seven (7) days following the date of PCI's mailing such materials to the Grand Prize Winner, which will be sent to the Grand Prize winner via overnight mail with prepaid overnight return envelope included. Travel companion must also be 18 years old or older and will (or his/her parent/legal guardian if travel companion is a resident of a jurisdiction that deems him/her to be a minor will) also be required to sign and return liability/publicity release which will be included in the Grand Prize Winner's package, along with the Grand Prize Winner's signed documents within such five (5) day period.
5. ODDS OF WINNING/PRIZES. Prizes are nontransferable and no cash or other substitutions will be offered. All federal, state and local taxes are the sole responsibility of the Winners. PCI, at its sole discretion, has the right to substitute a prize or prize component of equal or greater value if listed prize or prize component becomes unavailable. ONE (1) GRAND PRIZE PACKAGE: (1) Trip for Grand Prize Winner and one (1) travel companion to Los Angeles, CA including; Guided tour of the Playboy Mansion grounds; a poolside luncheonwith a Playboy Playmate (particular Playboy Playmate to be determined by PCI in its sole discretion); limousine transportation to/from the Playboy Mansion; transportation to/from airport in Los Angeles [LIMOUSINE TRANSPORTATION]; round trip coach air transportation departing from and returning to a major airport closest to Grand Prize Winner’s home (as determined by PCI in its sole discretion; air transportation will not be provided if Grand Prize winner’s residence is within 100 miles of Los Angeles, California), two (2) nights standard hotel accommodations (single room, double occupancy) selected by PCI and one (1) Perfect Stranger prize pack consisting of one (1) t-shirt and one (1) cap Total approximate retail value (“ARV”) of Grand Prize is $4,025. FIVE (5) FIRST PRIZE PACKAGES: One (1) Perfect Stranger prize pack consisting of one (1) t-shirt and one (1) cap (ARV $25 each). Total ARV of all prizes $4150.00. Actual value will be determined based on point of departure and any difference between the estimate grand prize value and the actual value of the prize will not be awarded. The odds of winning are based on the number of eligible entries received. Grand Prize Winner and travel companion must be available to travel sometime between the date that the winner is notified and before March 21, 2008. If travel is not completed by March 21, 2008, Grand Prize will be forfeited. Any expenses not specifically set forth herein, including, but not limited to, taxes, meals, gratuities, additional ground transportation, excursions, insurance, departure, airport taxes and other personal incidentals are solely the responsibility of Grand Prize Winner and travel companion. Grand prize trip is subject to air travel and hotel availability, holiday and blackout dates, and other restrictions. PCI will not replace any lost or stolen tickets, travel vouchers or certificates. If Grand Prize Winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the allotted travel companion. Travel companion must be at least 18 years of age or older and if he/she is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless he or she is the Grand Prize Winner. Grand Prize Winner and travel companion are responsible for obtaining all necessary and required travel documents.
6. ARBITRATION / WAIVER OF INJUNCTIVE RELIEF / GOVERNING LAW: BY SUBMITTING ENTRY, ENTRANTS AGREE THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES, ITS ENFORCEMENT, ARBITRABILITY OR INTERPRETATION SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION, TO BE HELD IN LOS ANGELES COUNTY, CALIFORNIA, BEFORE A SINGLE ARBITRATOR, IN ACCORDANCE WITH CALIFORNIA CODE OF CIVIL PROCEDURE §§ 1280 ET SEQ. THE ARBITRATOR SHALL BE SELECTED BY MUTUAL AGREEMENT OF THE PARTIES OR, IF THE PARTIES CANNOT AGREE, THEN BY SELECTING AN ARBITRATOR FROM A LIST OF ARBITRATORS SUPPLIED BY JAMS (JUDICIAL ARBITRATION AND MEDIATION SERVICES). IF THE PARTIES STILL CANNOT AGREE ON AN ARBITRATOR, THE ARBITRATOR SHALL BE APPOINTED BY JAMS. THE ARBITRATION SHALL BE A CONFIDENTIAL PROCEEDING, CLOSED TO THE GENERAL PUBLIC. THE ARBITRATOR SHALL ISSUE A WRITTEN OPINION STATING THE ESSENTIAL FINDINGS AND CONCLUSIONS UPON WHICH THE ARBITRATOR’S AWARD IS BASED. THE PARTIES WILL SHARE EQUALLY IN PAYMENT OF THE ARBITRATOR’S FEES AND ARBITRATION EXPENSES AND ANY OTHER COSTS UNIQUE TO THE ARBITRATION HEARING (RECOGNIZING THAT EACH SIDE BEARS ITS OWN DEPOSITION, WITNESS, EXPERT AND ATTORNEYS’ FEES AND OTHER EXPENSES TO THE SAME EXTENT AS IF THE MATTER WERE BEING HEARD IN COURT). NOTWITHSTANDING THE FOREGOING, THE ARBITRATOR MAY REQUIRE THAT SUCH FEES BE BORNE IN SUCH OTHER MANNER AS THE ARBITRATOR DETERMINES IS REQUIRED IN ORDER FOR THIS ARBITRATION CLAUSE TO BE ENFORCEABLE UNDER APPLICABLE LAW.
Entrants further understand and agree that they shall have no right to enjoin or restrain the development, production, advertising, promotion, distribution or exploitation of the Sweepstakes, Perfect Stranger, any other Sony Pictures Entertainment, Inc. (or any of its respective parent companies, subsidiaries or affiliates) production, project or picture.
Entrants acknowledge that the internal substantive laws (as distinguished from the choice of law rules) of the State of California and the United States of America applicable to contracts made and performed entirely in California shall govern the validity and interpretation of these Official Rules and all other causes of action (whether sounding in contract or in tort) arising out of or relating to these Official Rules.
