Official Playboy Miss Social Non-Nude Challange Rules
NO PURCHASE NECESSARY
1. CHALLENGE PERIOD: The Challenge begins at 12:00 pm Pacific Standard Time (“PST”) November 18, 2010 and ends 12:00 pm PST, December 22, 2010.
2. ELIGIBILITY: You must be at least (i) 19 years of age in Alabama, Wyoming, Nebraska; (ii) 21 years of age in Mississippi; and (iii) 18 years of age in all other states. You must be a legal US citizen or permanent US resident who is eligible to work in the United States during the period of your participation in the Challenge. During the course of the Challenge, you may be asked for two forms of government issued identification, such as a driver’s license or a passport. Neither you nor any of your immediate family members (including, without limitation, your spouse, domestic partner, parents, siblings, children, step-children) nor members of your household (whether or not related to you) may be employees, directors, officers, independent contractors, agents or representatives of Playboy.com, Inc. or any of its affiliated companies. We reserve the right to determine, in our sole discretion, whether a participant is sufficiently connected with Playboy.com such that such person’s participation in the Challenge could create the appearance of impropriety.
3. HOW TO PARTICIPATE: Participants must use social networking sites (e.g., YouTube, Twitter, Facebook) to promote themselves and urge their friends/followers/family/public to vote for them using votes purchased or earned through Playboy’s Miss Social Facebook application available on 11/18/10. The Challenge will be divided into a Main Round and two (2) rounds (each, a “Round”) as follows:
Each day during the Main Round (11/18/10- 12/22/10), the contestants with the most votes in each twenty-four (24) hour period will automatically gain entry into Round 1. If the same contestant obtains the most number of votes in more than one twenty-four (24) hour period, the contestant with the next most votes will proceed onto Round 1. Voting will be from 12 pm PT on 11/18/10 to 12 pm PT on 12/20/10. The top eligible vote recipients will be referred to herein as the “Finalists.”

Round 2 12/21/10 – 12/22/10 Top 1 Finalist will be the Grand Prize Winner
All Rounds begin at approximately 12:00 pm PST and end at approximately 12:00 pm PST. In the event of a tie in any Round, the first person to receive the most votes shall be the winner.
Beginning in the Main Round, Playboy.com may feature some or all of the finalists on one of Playboy’s web sites and/or through one of the social networking sites. Playboy.com does not guarantee that it will feature any or all of the finalists. All aspects of your campaign must comply with the terms and conditions of the site on which content is posted and with all applicable laws and regulations. Released Parties (as defined below) are not responsible for any unauthorized use by third parties of content created and posted by you in connection with the Challenge. NO NUDITY WHATSOEVER IS ALLOWED. YOU MAY ONLY SEND E-MAIL TO PROMOTE YOURSELF TO FRIENDS AND FAMILY. NO SPAMMING WHATSOEVER! DO NOT USE THIRD PARTY’S INTELLECTUAL PROPERTY. YOU MUST COMPLY WITH THE TERM AND CONDITIONS OF ALL SOCIAL NETWORKING SITES USED IN THIS CHALLENGE.
Fans may vote as often as they like. Votes that subvert the voting process with the intent to impair the integrity of the voting process will be void.
You hereby represent and warrant to Playboy.com that all content created by or for your for this Challenge is original and does not and will not infringe the rights of any third party, including any trademark, copyright, patent or other intellectual property rights. You will be entirely responsible for any claims made against content used by you in this Challenge.
If the content contains any material or elements that are not owned by you, and/or which are subject to the rights of third parties, you are responsible for obtaining, prior to use of such content, any and all releases and consents necessary to permit the use and exhibition of the content by Playboy.com in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the content. Playboy.com reserves the right to request proof of these permissions in a form acceptable to Playboy.com from you at any time. Failure to provide such proof may, if requested, result in disqualification. Playboy.com may disqualify contestants who do not strictly comply with all of the rules herein.
Each participant agrees to grant (i) Playboy.com a nonexclusive, perpetual, worldwide, royalty-free, fully paid-up license to any content used by participant in connection with this Challenge (including all rights embodied therein) and further agrees that Playboy.com and its designees may exploit, edit, modify, and distribute the content and all elements of such content, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, including on a Playboy.com web site or in Playboy magazine, without compensation, permission or notification to participant or any third party and (ii) the use of her name, voice, performance, photograph/video, image and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Playboy.com and its designees, without compensation (unless prohibited by law) or additional consents from participant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.
4. DOCUMENTATION: At Playboy.com’s request, you agree to sign and agree to any applicable model releases or other legal documents (including, but not limited to, an affidavit of eligibility and liability and publicity release) provided to you by Playboy.com and return same within the time period specified by Playboy.com. If Playboy.com doesn’t have the proper paperwork executed by you with the stated time period or cannot contact you within a reasonable time period or you are not in compliance with these Official Rules, you may be disqualified.
5. WINNER DETERMINATION: The Grand Prize Winner of the Challenge will be the Finalist who receives the highest number of valid votes in Round 2.
6. PRIZE: The Grand Prize Winner will receive (i) the title of Playboy’s Miss Social; (ii) a photography shoot at Playboy’s headquarters in Chicago, Illinois; (iii) an opportunity to host a party during the E3 convention at the Playboy Mansion in Los Angeles; (iv) 10 tickets to such party; and (v) an opportunity to appear as a character in one of Bigpoint’s video game. Trips to Chicago and Los Angeles consist of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to designated location and one night standard hotel accommodations (one room, double occupancy). If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Approximate Retail Value (“ARV”): $3500. Actual value may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Playboy.com or prize will be forfeited and Playboy.com will have no further obligation to such winner. Playboy.com reserves right to change dates. Travel must be made through Playboy.com’s agent, on a carrier of Playboy.com’s choice. Certain travel restrictions may apply. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including transportation, meals, souvenirs, and gratuities are the sole responsibility of the winners. Playboy.com is under no obligation to feature the winner on one of Playboy’s web sites or in Playboy magazine. Photographer and all other details of shoot will be determined by Playboy.com. All photos, film and other materials resulting from the photo shoot (“Materials”) will be owned by Playboy.com and Playboy.com and its designees shall have the right, but not the obligation, to use, reproduce, modify, publish, post, create derivative works from, and display such Materials and all elements embodied therein, including, without limitation, any names and likenesses, in whole or in part, on a worldwide perpetual basis, and to incorporate the Materials into other works, in any form, media or technology now known or later developed, for internal, advertising, commercial and promotional purposes. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Playboy.com. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Playboy.com reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Playboy.com’s sole discretion.
7. GENERAL CONDITIONS/RELEASE: By participating in the Challenge, you agree (i) to be bound by these rules and the decisions of Playboy.com and the voting audience, and (ii) to release and hold harmless Playboy.com, Inc., its parent, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, agents, employees and representatives (collectively, “Released Parties”) for any damage, loss or liability to person or property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize (including any travel or activity related thereto) or participation in the Challenge. Any and all disputes, claims and causes of action arising out of or connected with this Challenge, or any prize awarded, shall be resolved individually, without resort to any form of class action. This Challenge will be governed by and interpreted under the laws of the State of Illinois, U.S.A. without regard to its conflicts of laws provisions. All participants agree that any and all disputes arising out of or relating in any way to this Challenge shall be litigated only in courts sitting in Cook County, Illinois, U.S.A. Claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Challenge, but in no event attorneys’ fees. This Challenge is void where prohibited and subject to all applicable federal, state and local laws. Playboy.com reserves the right, in its sole discretion to cancel or suspend part or all of this Challenge for any reason, including but not limited to, should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security , fairness or proper play of the Challenge. Released Parties shall not be responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled votes or for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by Playboy.com, users or by any of the equipment or programming associated with or utilized in the Challenge or by any technical or human error which may occur in the processing or submissions which may damage a user’s system or limit a participant’s ability to participate in the Challenge or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Challenge, including, without limitation, errors or difficulties which may occur in connection with the administration of the Challenge, the tabulation of votes, the announcement of the prize or in any Contest-related materials. Playboy.com may prohibit an participant from participating in the Challenge or winning a prize if, in its sole discretion, it determines that said participant is attempting to undermine the legitimate operation of the Challenge by cheating, hacking, deception or other unfair playing practices or intending to annoy, abuse, threaten, or harass any other participants of Playboy.com representatives.
8. WINNER: The name of the winner will be announced on 12/22/10 on Facebook & other social media channels.
